The bill amends Section 425.041 of the Florida Statutes to prohibit retail electric cooperatives from adopting, enacting, or enforcing certain fees, including lot fees, developer fees, or surcharges. This prohibition applies to any bylaws, tariffs, or policies that would restrict or prohibit the types or fuel sources of energy production that can be used, delivered, converted, or supplied by specified entities. The bill also clarifies the applicability of this prohibition to the entities listed in s. 366.032(1)(b)-(e), which are authorized to serve customers.
Additionally, the bill ensures that the use of appliances that utilize these energy sources is not restricted by the cooperatives. The term "appliance" is defined to include devices manufactured to use energy, which must comply with the Florida Building Code or the Florida Fire Prevention Code. The act is set to take effect on July 1, 2026.
