The definition excludes discussions between healthcare providers and patients, as well as promotional materials displayed in clinical settings. Additionally, the bill establishes that manufacturers can be held liable if their advertised vaccine causes harm to an individual.

Furthermore, the bill allows individuals to file a cause of action against manufacturers within three years of the incident, regardless of other laws. If a claimant prevails in such an action, they are entitled to actual damages, court costs, and reasonable attorney fees. The act is set to take effect on July 1, 2026.
