The bill amends section 499.0054 of the Florida Statutes to introduce new definitions and provisions regarding the advertisement of vaccines. It defines "advertise" to encompass various forms of media communication, including television, radio, print, and digital platforms, specifically when a vaccine manufacturer promotes their vaccine. The definition excludes discussions between healthcare providers and patients, as well as promotional materials displayed in clinical settings.
Additionally, the bill establishes manufacturer liability, stating that if a vaccine advertised in Florida causes harm to an individual, the manufacturer can be held liable. It allows individuals to file a cause of action within three years of the incident and mandates that prevailing claimants are entitled to actual damages, court costs, and reasonable attorney fees. The act is set to take effect on October 1, 2026.
