This bill establishes provisions for living organ donation in Florida by creating two new sections in the Florida Statutes. Section 110.1185 mandates that state agencies provide up to 30 days of paid administrative leave for employees who serve as living organ donors, in addition to any other leave authorized by law. The bill defines a living organ donor as an individual who donates all or part of a human organ while alive for transplantation.
Additionally, Section 381.865 requires private employers and local governments to grant unpaid leave to employees who wish to serve as living organ donors, contingent upon a written request from the employee. The length of this unpaid leave must be either the time requested by the employee or 30 working days, whichever is shorter, while allowing employers the discretion to offer longer leave periods. The bill is set to take effect on July 1, 2026.
