This bill establishes new regulations regarding the use of artificial intelligence (AI) in psychological and therapeutic practices in Florida. It creates two new sections in the Florida Statutes, 490.016 and 491.019, which define artificial intelligence as any machine-based system that can infer outputs from inputs to influence environments. The bill prohibits licensed professionals in psychology, clinical social work, marriage and family therapy, and mental health counseling from using AI in their practices, with specific exceptions. These exceptions allow for the use of AI in administrative tasks such as managing appointments, drafting communications unrelated to therapy, processing billing, managing patient records, and analyzing operational data. Additionally, AI may be used to record or transcribe therapy sessions, provided that written, informed consent is obtained from the client at least 24 hours in advance.

The bill emphasizes the importance of human oversight in therapeutic practices by restricting the use of AI to non-therapeutic functions. It aims to ensure that the integrity of psychological and counseling services is maintained while still allowing for some technological assistance in administrative capacities. The act is set to take effect on July 1, 2026.
