The bill outlines specific circumstances under which a driver may be deactivated, including poor rider ratings, violations of safety or other policies, and failure to meet vehicle or insurance requirements. It mandates that TNCs establish and maintain a clear, written deactivation policy that allows drivers to appeal their deactivation.
Additionally, the bill requires TNCs to contract with a nonprofit organization experienced in assisting diverse populations to help drivers navigate the appeals process. TNCs must review appeals and issue determinations within 30 days, assessing whether the evidence supports the deactivation. Deactivated drivers have the right to appeal to a mutually agreed-upon third-party arbitrator, with a specified process for selecting the arbitrator if an agreement cannot be reached. The bill also clarifies that drivers retain the right to pursue legal action in court regarding their deactivation circumstances. The act is set to take effect on July 1, 2026.
