This bill establishes new regulations regarding the use of artificial intelligence (AI) in psychological and therapeutic practices in Florida. It creates two new sections in the Florida Statutes: 490.016 and 491.019, which define "artificial intelligence" as a machine-based system that can infer outputs from inputs. The bill prohibits licensed professionals in psychology, clinical social work, marriage and family therapy, and mental health counseling from using AI in their practices, with specific exceptions. These exceptions allow for the use of AI in administrative and supplementary support services, such as managing appointment scheduling, drafting communications, processing billing, and analyzing operational data. Additionally, AI may be used to record or transcribe therapy sessions, provided that written, informed consent is obtained from the client at least 24 hours prior to the session.

The bill aims to ensure that the integrity of psychological and therapeutic services is maintained while allowing for the integration of technology in non-clinical aspects of practice. The effective date for this legislation is set for July 1, 2026.
