This bill amends Florida law to address violations of state immigration laws by establishing a framework for compensating victims harmed by unauthorized aliens. It requires the Department of Law Enforcement to impose a fine of $10,000 for each violation of immigration enforcement assistance agreements, with the collected funds directed towards compensating victims as outlined in the newly created section 908.14. This section defines "unauthorized alien" and sets eligibility criteria for compensation, including that the harm must have occurred in Florida on or after July 1, 2026, and that the unauthorized alien must have materially contributed to the harm.

Additionally, the bill creates section 908.15, which allows the estate of a person killed by an unauthorized alien to bring a cause of action against local governmental entities or law enforcement agencies that have sanctuary policies or violate immigration enforcement agreements. Plaintiffs must prove by a preponderance of the evidence that the failure to cooperate with federal immigration authorities contributed to the death. The bill also waives sovereign immunity for the state in these cases, ensuring that actions brought under this new provision are not subject to the limitations typically applied under section 768.28. The act is set to take effect on July 1, 2026.
