Additionally, the bill introduces section 908.15, which allows the estate of a person killed by an unauthorized alien to pursue legal action against local governmental entities or law enforcement agencies that have sanctuary policies or fail to comply with immigration enforcement agreements. Plaintiffs must demonstrate that the failure to cooperate with federal immigration authorities materially contributed to the death. The bill also waives sovereign immunity for the state in such cases, ensuring that actions brought under this new cause of action are not subject to the limitations typically imposed by sovereign immunity laws. The act is set to take effect on July 1, 2026.
