The bill amends Section 425.041 of the Florida Statutes to prohibit rural electric cooperatives that sell electricity at retail from adopting or enforcing certain fees, including lot fees, developer fees, or surcharges. This prohibition extends to any bylaws, tariffs, or policies that would restrict or prohibit the types or fuel sources of energy production that can be used, delivered, converted, or supplied by specified entities. The bill also revises the applicability of this prohibition to include specific entities listed in s. 366.032(1)(b)-(e), replacing the previous reference to s. 366.032(1).

The effective date for this act is set for July 1, 2026. The changes aim to ensure that rural electric cooperatives do not impose fees or restrictions that could limit energy production options or the use of appliances that rely on various fuel sources.
