The bill amends Section 499.0121 of the Florida Statutes to exempt establishments that store, warehouse, or hold noncontrolled prescription drugs solely for the purpose of arranging for their destruction from compliance with certain specified provisions. It removes the requirement for the department to adopt rules for the storage and handling of prescription drugs and the establishment and maintenance of distribution records. The bill emphasizes the importance of maintaining proper records and conditions for the storage of prescription drugs, including security measures and procedures for handling outdated or damaged drugs, while outlining the responsibilities of wholesale distributors regarding the receipt, security, storage, and distribution of prescription drugs.

Additionally, the bill introduces new reporting requirements for pharmacy drug wholesale distributors, manufacturers, and repackagers concerning controlled substance distributions, mandating electronic reports if no distributions occur in a month. It establishes due diligence requirements for wholesale distributors and pharmacies handling controlled substances, including credentialing policies and monitoring purchasing patterns for suspicious transactions. The Department of Law Enforcement is tasked with investigating purchasing levels that seem inconsistent with clinical needs. The act is set to take effect on July 1, 2026.
