The bill amends Section 499.0121 of the Florida Statutes to exempt establishments that store, warehouse, or hold noncontrolled prescription drugs solely for the purpose of arranging for their destruction from compliance with certain specified provisions. It requires these establishments to maintain specific information related to the storage and handling of these drugs. Additionally, the bill removes the requirement for the department to adopt rules to protect public health, safety, and welfare concerning the storage and handling of prescription drugs, as well as the establishment and maintenance of prescription drug distribution records. This change aims to streamline the regulatory process while ensuring necessary records are still maintained.
Furthermore, the bill mandates that pharmacy drug wholesale distributors, manufacturers, or repackagers submit a monthly report to the federal Drug Enforcement Administration (DEA) if no controlled substance distributions occur during that month. This report must be submitted electronically and include specific information such as DEA registration numbers and transaction codes. New provisions also outline due diligence requirements for wholesale distributors and pharmacies regarding the credentialing of physicians and pharmacies that receive controlled substances, requiring them to maintain records of their processes and assess purchasing patterns for suspicious transactions. The act is set to take effect on July 1, 2026.
