The bill amends section 316.613 of the Florida Statutes to enhance child restraint requirements in motor vehicles. It specifies that children aged 8 years or younger must be secured in a crash-tested, federally approved child restraint device. The bill introduces a new requirement for children aged 6 through 8 years to use a child booster seat, while also providing exceptions for children over 4 feet 9 inches in height. Additionally, it clarifies that the requirement for using a child restraint device does not apply in certain situations, such as when a child is being transported by someone outside their immediate family, during a medical emergency, or if a medical condition necessitates an exception.
The bill also outlines penalties for violations, classifying them as moving violations that result in 3 points being assessed against the driver's license. However, individuals may opt to participate in an approved child restraint safety program to potentially waive the penalties and points upon completion. The Department of Highway Safety and Motor Vehicles is tasked with providing notice of these requirements alongside motor vehicle license tag deliveries. The act is set to take effect on July 1, 2026.
