The proposed bill, titled the "Shane Jones Act," aims to address violations of state immigration law by establishing penalties and compensation mechanisms related to unauthorized aliens. It amends section 908.11 of the Florida Statutes to require the Department of Law Enforcement to impose a fine of $10,000 on law enforcement agencies for each violation of immigration enforcement assistance agreements. The collected fines will be used to compensate victims harmed by unauthorized aliens, as outlined in the newly created section 908.14. This section defines "unauthorized alien" and sets forth eligibility criteria for compensation, including the requirement that the harm occurred in Florida after July 1, 2026, and that the unauthorized alien materially contributed to the harm.
Additionally, the bill creates section 908.15, which establishes a cause of action for wrongful death caused by unauthorized aliens. It allows the estate of a deceased person to sue local governmental entities or law enforcement agencies that have sanctuary policies or violate immigration enforcement agreements. The plaintiff must demonstrate that the failure of these entities to cooperate with federal immigration authorities contributed to the death. The bill also amends section 768.28 to clarify that sovereign immunity does not apply to actions brought under section 908.15, thereby allowing for legal recourse in these cases. The act is set to take effect on July 1, 2026.
