This bill aims to regulate auxiliary containers in Florida by defining key terms such as "auxiliary container" and "single-use." It preempts local governments from enacting regulations on the use, sale, or distribution of auxiliary containers that conflict with state law, while allowing for certain exceptions. The Department of Environmental Protection (DEP) is tasked with developing a uniform ordinance for the use and disposal of single-use, nonrecyclable auxiliary containers, which will involve collaboration with various stakeholders and public workshops. Additionally, the bill mandates the elimination of single-use plastic auxiliary containers on state-managed lands and prohibits the use of containers made from polystyrene foam.
The bill also includes the repeal of a previous statute related to the regulation of polystyrene products and requires the DEP to create a statewide Marine Debris Reduction Plan by the end of 2026. This plan will focus on strategies to reduce plastic and other litter in marine environments, as well as provide recommendations for funding and implementation. The effective date for the provisions of this act is set for July 1, 2026.
