This bill amends section 893.138 of the Florida Statutes to expand the definition of public nuisances to include locations used as gambling houses. It revises the criteria for declaring a public nuisance, allowing for properties that have been used for specific illegal activities, including gambling, to be subject to abatement procedures. The bill also removes the previous cap on the total fines that could be imposed for public nuisances, which was set at $15,000, and introduces a new structure for assessing fines based on the severity of the nuisance and the actions taken by property owners to address it.

Additionally, the bill defines the term "legal assistant" and stipulates that if attorney fees are requested in nuisance cases, the board must also award fees for legal assistants who provide meaningful support. It allows for the continuation of jurisdiction over declared nuisances for up to two years and establishes procedures for the foreclosure of properties with unpaid liens related to public nuisances. The effective date for this act is set for July 1, 2026.
