This bill establishes a new section, 491.023, in the Florida Statutes, which provides exemptions from public records and meetings requirements for certain information related to the Social Work Licensure Interstate Compact. Specifically, it exempts a social worker's personal identifying information—excluding their name, licensure status, or licensure number—held by the Department of Health or the Board of Clinical Social Work, Marriage and Family Therapy, and Mental Health Counseling from public disclosure unless authorized by the state that reported the information. Additionally, meetings of the Social Work Licensure Compact Commission and its committees, where matters exempt from disclosure by law are discussed, are also exempt from public meeting requirements. Recordings, minutes, and records generated during these exempt meetings are similarly protected from public records requirements.

The bill includes provisions for future legislative review and repeal of these exemptions, with a sunset date set for October 2, 2031, unless the exemptions are reenacted. The Legislature asserts that these exemptions are a public necessity to effectively implement and administer the Social Work Licensure Interstate Compact, which requires confidentiality for certain sensitive discussions and information. The act is contingent upon the passage of related legislation, specifically HB 13 or similar, during the same legislative session.
