This bill establishes new regulations for nonparticipating and out-of-network nurse registries and home health agencies in Florida. It creates several new sections in the Florida Statutes that prohibit state group health insurance plans, Medicaid managed care plans, individual health insurers, and health maintenance organizations from restricting participants, recipients, enrollees, policyholders, and subscribers from obtaining care from these nonparticipating or out-of-network providers. Additionally, the bill prohibits these entities from steering or unduly influencing individuals to select in-network providers. Importantly, it mandates that nonparticipating and out-of-network nurse registries and home health agencies must be reimbursed at the same rate as in-network providers for equivalent services.

The bill also amends existing law by adding a new subsection to section 627.662, which outlines the applicability of these prohibitions to group health insurance, blanket health insurance, and franchise health insurance. The effective date for this act is set for July 1, 2026. Overall, the legislation aims to enhance access to care by ensuring that individuals can choose their healthcare providers without undue restrictions or financial penalties.
