This bill provides for the compensation of Lourdes Latour and Edward Latour by Miami-Dade County for injuries sustained due to the county's negligence. On November 5, 2017, Lourdes Latour was seriously injured when a malfunctioning automatic gate arm struck her while she was riding her bicycle. Following a lawsuit, a jury found Miami-Dade County 100 percent liable and awarded Mrs. Latour $4.75 million and Mr. Latour $165,000 for his loss of consortium. After reaching a settlement, Miami-Dade County agreed to pay a total of $800,000, with $300,000 already paid and the remaining $500,000 to be appropriated through this bill.

The bill includes several key provisions: it declares the facts stated in the preamble to be true, authorizes Miami-Dade County to appropriate $500,000 for the Latours, and stipulates that this amount, along with any payments made under Florida Statutes, will serve as the sole compensation for all claims related to the incident. Additionally, it limits attorney fees to a maximum of 25 percent of the total amount awarded. The act is set to take effect upon becoming law.
