This bill amends section 456.0575 of the Florida Statutes to enhance the responsibilities of health care practitioners regarding referrals to out-of-network providers. It requires practitioners or their employees to confirm whether a referral provider is part of the patient's health insurer or health maintenance organization's network when providing nonemergency services. This confirmation can be made by contacting either the referral provider or the patient's insurer. However, if the patient declines to provide necessary information or the confirmation itself, the practitioner is not obligated to comply with this requirement.
Additionally, the bill mandates that practitioners must inform patients in writing that services from out-of-network providers may incur additional costs not covered by their health insurance. This notification must be documented in the patient's medical record. Noncompliance with these provisions may lead to disciplinary action against the practitioner. The Department of Health is also authorized to adopt rules to implement these changes, with the act set to take effect on July 1, 2025.
