The bill establishes new requirements for health care licensees and practitioners regarding the refund of overpayments made by patients. It creates two new sections in the Florida Statutes: 408.12 and 456.0625. Under these sections, any licensee or health care practitioner who tenders charges for reimbursement must refund any overpayment to the patient within 30 days of determining that an overpayment occurred. The term "tenders charges for reimbursement" is defined as filing a claim for reimbursement with government-sponsored programs or private health insurers. The bill also specifies that these provisions do not apply to overpayments governed by sections 627.6131 or 641.3155.
Additionally, the bill amends existing statutes to impose penalties for non-compliance. Specifically, it allows the Agency for Health Care Administration to impose administrative fines for failing to refund patient overpayments, as outlined in the newly created section 408.12. Furthermore, it adds failure to comply with the refund requirements as grounds for disciplinary action against health care practitioners under section 456.072. The bill is set to take effect on January 1, 2026.
