The proposed bill establishes new regulations regarding the use of toxic chemicals in cosmetic products in Florida. It creates a new section, 499.0095, which prohibits the manufacture, sale, or distribution of cosmetics containing specific harmful chemicals, including ortho-phthalates, PFAS, formaldehyde, and others, starting July 1, 2026. An exception is made for in-state retailers who may sell existing stock until July 1, 2027. The Department of Business and Professional Regulation (DBPR), in consultation with the Department of Health, is tasked with identifying and assessing alternative chemicals that can serve similar functions in cosmetics, with findings to be made publicly available by January 1, 2026.

Additionally, the bill mandates that the DBPR adopt rules to implement these restrictions, including a process for identifying chemicals that release formaldehyde and engaging with stakeholders for input. Violations of this section will result in disciplinary action under existing law. The act is set to take effect on July 1, 2025, allowing time for compliance and preparation for the new regulations.
