This bill amends section 267.21 of the Florida Statutes to enhance access to historic cemeteries located on private land. It establishes that if credible evidence indicates the presence of an abandoned cemetery on or near privately owned land, the state is entitled to an easement for ingress and egress. This easement is intended for the maintenance of the cemetery and for conducting research and noninvasive searches related to the Historic Cemeteries Program.

The bill specifies that access must occur at reasonable times and in a reasonable manner, with the requirement that the private landowner is given reasonable notice prior to such access. The new provisions aim to balance the state's need to preserve historic cemeteries with the rights of private property owners. The act is set to take effect on July 1, 2025.
