The bill amends section 106.147 of the Florida Statutes to prohibit campaign-related telephone calls and text messages to voters who indicate they do not consent to such communications. It establishes that candidates, individuals, or organizations must immediately cease all communications with a voter upon receiving their indication of non-consent. Voters can express their lack of consent during a phone call or by responding "Stop" to a text message. Additionally, if the responsible party fails to stop communications, the voter is granted the right to take legal action in a court of competent jurisdiction and may be entitled to reasonable attorney fees and costs if they successfully enjoin the violation.
The bill also redesignates the existing subsection (4) as subsection (5) and introduces a new subsection (4) that outlines these provisions. It specifies that any person who willfully violates this section commits a misdemeanor of the first degree, with penalties as provided in sections 775.082 or 775.083. The act is set to take effect on July 1, 2025.
