The bill introduces a new section, 901.1501, to the Florida Statutes, which grants law enforcement officers the discretion to determine whether to make an immediate arrest of individuals with significant medical conditions who are residing in or confined to a hospital or long-term care facility. The law enforcement officer is required to consider the totality of the circumstances, including the individual's threat to public safety and flight risk, as well as all lawful methods of making an arrest, such as seeking an arrest warrant. This provision specifically applies to offenses listed in sections 903.011(6) and 907.041(5)(a).
Additionally, the bill clarifies that it does not prevent law enforcement officers from arresting individuals without a warrant under section 901.15 or using any lawful method for making an arrest. The act is set to take effect on July 1, 2025.
