The bill amends section 409.904 of the Florida Statutes to establish a presumption of continued Medicaid eligibility for individuals who are permanently disabled and receiving specific Medicaid-covered services, such as institutional care, hospice, or home and community-based services. It mandates that these individuals be presumed eligible for continued coverage during the redetermination process, with the Agency for Health Care Administration required to maintain payments for these services unless there is a material change in the individual's disability or economic status. In such cases, the individual or their representative must notify the agency and the Department of Children and Families, which may then conduct a redetermination of eligibility.
Additionally, the bill defines "permanently disabled" as a person who has been certified by a licensed physician as having a permanent disability. The Agency for Health Care Administration is tasked with seeking federal authorization to exempt permanently disabled Medicaid recipients from annual eligibility redetermination. The agency and the Department of Children and Families are also required to develop a process to facilitate necessary notifications regarding changes in status. The act is set to take effect on July 1, 2025.
