The proposed bill amends sections 627.6131 and 641.315 of the Florida Statutes to enhance the payment processes for physicians and dentists by health insurers and health maintenance organizations (HMOs). It prohibits contracts from designating credit card payments as the sole method of payment, allowing for electronic funds transfers instead. Health insurers and HMOs must notify providers of any fees associated with electronic transfers and obtain their consent before using this payment method. Additionally, the bill prohibits these organizations from charging fees for automated clearinghouse transfers unless the provider has consented to such fees. The new provisions will apply to contracts delivered, issued, or renewed on or after January 1, 2025, for dentists and January 1, 2026, for physicians.

Furthermore, the bill establishes that health insurers and HMOs cannot deny claims submitted by providers for procedures included in prior authorizations unless specific conditions are met, such as changes in patient eligibility or documentation issues. The bill also removes the term "dental" from certain provisions, broadening the scope to include physicians. The effective date for the act is set for July 1, 2025.
