This bill amends section 704.06 of the Florida Statutes to establish a process for the release of conservation easements by water management districts. It requires that, upon application by the fee simple owner of a parcel subject to a conservation easement, the district must release the easement if specific conditions are met. These conditions include the land being less than 15 acres and bordered on three or more sides by impervious surfaces, adjacent undeveloped parcels also being less than 15 acres and similarly bordered, the absence of historical or cultural significance on the land, and the applicant securing sufficient mitigation credits to offset any loss of wetlands.
Additionally, the bill stipulates that once the conservation easement is released, the ad valorem taxes on the property will be based on its just value, and the land may be developed in accordance with the zoning designation of adjacent lands. The effective date for this act is set for July 1, 2025.
