The bill amends section 117.05 of the Florida Statutes to prohibit notaries public from using certain terms in their advertisements that may imply they have legal expertise in immigration matters, specifically terms like "notario público," "immigration assistant," and similar titles. Additionally, it requires notaries who advertise in languages other than English to include a conspicuous notice stating that they are not licensed attorneys and cannot provide legal advice. A new section, 117.051, is created to establish a civil cause of action for individuals harmed by violations of these advertising regulations, allowing them to seek declaratory or injunctive relief, actual damages, and attorney fees.
Furthermore, the bill introduces section 501.1391, which mandates that businesses or individuals offering immigration services, who are not licensed attorneys, must display a clear notice on their websites and at their places of business stating that they are not authorized to provide legal advice or represent clients in immigration matters. This section also provides a civil cause of action for those aggrieved by violations of this requirement, allowing for similar remedies as outlined in section 117.051. The act is set to take effect on July 1, 2025.
