The bill amends section 117.05 of the Florida Statutes to prohibit notaries public from using certain terms, such as "notario público" and "immigration consultant," when advertising their services if they are not authorized to represent individuals in immigration matters. It also requires that notaries who advertise in languages other than English include a conspicuous notice stating that they are not attorneys and cannot provide legal advice. Additionally, the bill creates a new section, 117.051, which establishes a civil cause of action for individuals harmed by violations of these advertising regulations, allowing them to seek declaratory or injunctive relief, actual damages, and reasonable attorney fees.

Furthermore, the bill introduces section 501.1391, which mandates that businesses or individuals offering immigration services, who are not licensed attorneys, must post clear notices on their websites and at their places of business stating that they are not licensed to practice law and are not accredited to represent clients in immigration matters. Similar to the previous section, this provision also allows aggrieved individuals to pursue civil action for violations, including seeking damages and attorney fees. The act is set to take effect on July 1, 2025.
