This bill amends section 943.0315 of the Florida Statutes to provide specific exemptions from public record and meeting requirements related to reports and notifications concerning adversarial threats to state assets and critical infrastructure. The Chief of Domestic Security is required to produce a confidential report by July 1, 2026, detailing risks to state assets and military installations in the event of a Pacific conflict. This report, along with notifications to owners and operators of critical infrastructure identified as potential targets, will be exempt from public disclosure under sections 119.07(1) and 24(a) of the State Constitution. Additionally, any discussions regarding these reports or notifications during meetings of the Council on Pacific Conflict will also be exempt from public meeting requirements.
The bill includes statements of public necessity, emphasizing that the confidentiality of the report and notifications is crucial to prevent malicious acts that could arise from the disclosure of vulnerabilities in critical infrastructure. The exemptions are subject to the Open Government Sunset Review Act and will be repealed on October 2, 2030, unless the Legislature reenacts them. The act will take effect concurrently with SB 912 or similar legislation, should it be adopted in the same legislative session.
