The bill appropriates a total of $14,926,639.56 from the General Revenue Fund to compensate H.H. for the damages sustained as a result of DCF's failure to adequately investigate multiple child abuse reports. The bill acknowledges the catastrophic injuries H.H. endured, including permanent brain damage and the need for ongoing medical care, which were directly linked to the department's negligence in protecting her from harm.
Additionally, the bill stipulates that the Chief Financial Officer is to issue a warrant for the appropriated funds to be paid into an irrevocable trust for H.H.'s benefit. It also expresses the intent of the Legislature to waive any government liens, including Medicaid liens, related to H.H.'s treatment. Furthermore, it establishes that the total amount awarded under this act, along with the amount previously paid by DCF, is intended to be the sole compensation for all claims arising from the circumstances leading to H.H.'s injuries, with attorney fees capped at 25% of the total award.
