The bill acknowledges the catastrophic injuries H.H. endured, including permanent brain damage and the need for ongoing medical care, which were exacerbated by DCF's negligence in assessing the risk to her safety.
Additionally, the bill stipulates that the Chief Financial Officer is to issue a warrant for the appropriated funds to be paid into an irrevocable trust for H.H.'s benefit. It also includes provisions to waive any government liens, such as Medicaid liens, related to H.H.'s treatment, and establishes that the compensation provided under this act is intended to cover all present and future claims arising from the circumstances described. Furthermore, the bill limits attorney fees related to this claim to a maximum of 25% of the total amount awarded.
