This bill amends various sections of Florida Statutes to introduce and regulate railroad traffic infraction detectors and speed detection systems. It defines "railroad traffic infraction detector" as a system that captures images or video of vehicles violating traffic laws at railroad crossings. Counties and municipalities are authorized to install these detectors at at-grade railroad crossings with the railroad owner's permission, contingent upon enacting an ordinance that includes a public hearing to assess safety risks. The Department of Transportation is also empowered to enforce speed limits in work zones using speed detection systems, with requirements for public notification and signage regarding their use.
Additionally, the bill establishes procedures for issuing traffic citations related to violations detected by these systems, including a requirement for notifications to be sent to vehicle owners within 30 days. It specifies that the owner is generally liable for violations unless they provide an affidavit identifying another responsible person. The bill also outlines the financial implications of traffic violations, detailing the distribution of collected penalties, with a portion supporting the School Crossing Guard Recruitment and Retention Program. It emphasizes electronic documentation and reporting, mandates electronic payment of penalties, and establishes guidelines for the use of speed detection systems in work zones, ensuring they are used solely for documenting violations. The act is set to take effect on July 1, 2025.
