This bill amends section 373.423 of the Florida Statutes to enhance the inspection and maintenance requirements for stormwater management systems operated by municipal separate storm sewer (MS4) entities. It introduces definitions for "MS4" and "MS4 entity," and mandates that each MS4 entity conduct an operation and maintenance inspection of all permitted stormwater management systems by September 1, 2026. The inspections must identify any infrastructure that is significantly vulnerable to obstruction or failure, which could lead to flooding and property damage. Additionally, any infrastructure meeting these criteria must be inspected annually starting June 1, 2027.

Furthermore, the bill requires MS4 entities to complete a stormwater facility inspection checklist during each inspection, which must be submitted to the Department of Environmental Protection and the Division of Emergency Management by September 1, 2026, and annually thereafter. The checklist must include details about any identified vulnerable infrastructure. The act is set to take effect on July 1, 2025.
