The proposed bill establishes a new section, 500.181, in the Florida Statutes, which mandates that food and drink products intended for human consumption that contain synthetic dyes must display a warning on their packaging. This warning states, "WARNING: This product contains synthetic colors, which may have an adverse effect on activity and attention in children." Manufacturers are allowed to use adhesive stickers for this warning until December 31, 2028, after which the warning must be printed directly on the packaging. The bill outlines specific synthetic color additives that are covered under this requirement, including Blue 1, Red 40, and Yellow 5, among others.

Additionally, the bill sets forth penalties for manufacturers and retailers who fail to comply with the warning requirements. Manufacturers may face fines ranging from $1,000 for a first offense to $5,000 for subsequent offenses, while retailers and distributors may receive written warnings or fines up to $2,500 for repeated violations. The collected fines will be deposited into the Department of Agriculture and Consumer Services' General Inspection Trust Fund, which will also be responsible for conducting inspections related to this new regulation. The act is set to take effect upon becoming law.
