The proposed bill establishes a new section, 500.181, in the Florida Statutes, which mandates that food and drink products intended for human consumption that contain synthetic dyes must display a warning on their packaging. This warning states, "WARNING: This product contains synthetic colors, which may have an adverse effect on activity and attention in children." Manufacturers are allowed to use adhesive stickers for this warning until December 31, 2028, after which the warning must be printed directly on the packaging. The bill outlines specific synthetic color additives that are covered under this requirement, including Blue 1, Red 40, and Yellow 5, among others.
The bill also establishes penalties for manufacturers, retailers, and distributors who fail to comply with the warning requirements. Manufacturers face fines ranging from $1,000 for a first offense to $5,000 for subsequent offenses, while retailers and distributors face escalating penalties, starting with a written warning for a first offense and fines up to $2,500 for repeated violations. Additionally, the bill requires the Department of Agriculture and Consumer Services to conduct inspections as part of regular food and drink product inspections, and it stipulates that collected fines will be deposited into the department's General Inspection Trust Fund. The act is set to take effect upon becoming law.
