This bill amends Florida Statutes regarding wrongful death claims by removing a provision that previously prohibited adult children from recovering certain damages and parents of adult children from recovering damages related to medical negligence claims. Specifically, the language that stated, "The damages specified in subsection (3) shall not be recoverable by adult children and the damages specified in subsection (4) shall not be recoverable by parents of an adult child with respect to claims for medical negligence" has been deleted from section 768.21. This change allows for a broader scope of recovery for these parties in wrongful death proceedings.
Additionally, the bill makes conforming amendments to sections related to civil enforcement in nursing homes and the rights of residents, clarifying that actions for violations of rights or negligence are not classified as medical malpractice. The bill also reenacts certain sections to incorporate the amendments made to section 768.21. The effective date for this act is set for July 1, 2025.
