The bill establishes a framework for nonopioid advance directives in Florida, mandating the Department of Health to create a voluntary form that allows individuals to express their preference against being prescribed or administered opioid drugs for pain management or palliative care in the event they become incapacitated. The form will be accessible on the Department's website and must be signed by both the patient and a licensed physician. It is required to be filed in the patient's medical record with a chosen healthcare facility or provider, and it can be revoked by the patient at any time, either verbally or in writing.
Additionally, the bill provides legal protections for healthcare providers who may prescribe opioids in medical emergency situations without knowledge of a patient's nonopioid advance directive. Such providers will not face civil or criminal liability unless their actions are deemed grossly negligent or willful misconduct. The bill defines a "medical emergency situation" as an acute injury or illness that poses an immediate risk to a person's life or long-term health. The act is set to take effect on July 1, 2025.
