This bill establishes regulations regarding the provenance of digital content, particularly focusing on content generated by generative artificial intelligence (AI). It amends existing laws to define "provenance data" and mandates that any digital content depicting electoral candidates created by generative AI must include this provenance data. Additionally, it creates a digital content provenance pilot program within the Division of Emergency Management, which will require the inclusion of a conspicuous indicator with an encoded link to access provenance data for digital images and videos created after July 1, 2025. The division is also tasked with submitting an annual report to the Legislature regarding the pilot program's effectiveness and potential scalability.

Furthermore, the bill outlines responsibilities for providers of generative AI tools, requiring them to apply provenance data to synthetic content and provide public access to tools that can identify such content. Social media platforms are required to retain and display provenance data for synthetic content, while capture devices sold in Florida must have the capability to record provenance data. Violations of these provisions are classified as unfair or deceptive acts, with enforcement responsibilities assigned to the Attorney General. The act is set to take effect on July 1, 2025.
