The proposed bill aims to establish regulations regarding the provenance of digital content, particularly focusing on content generated by generative artificial intelligence (AI). It amends existing laws to define "provenance data" and mandates that any digital content created by generative AI that features electoral candidates must include this provenance data. Additionally, the bill creates a digital content provenance pilot program within the Division of Emergency Management, which will require the division to include a conspicuous indicator with an encoded link on digital images and videos created after a specified date, allowing users to access provenance data. The division is also tasked with submitting an annual report to the Legislature regarding the pilot program's effectiveness and potential scalability.
Furthermore, the bill outlines responsibilities for providers of generative AI tools, requiring them to apply provenance data to synthetic content and make tools available for the public to verify the authenticity of such content. It also mandates social media platforms to retain and display provenance data for synthetic content shared on their platforms. Capture devices sold in Florida must have the capability to record provenance data, and manufacturers must ensure this data is accessible to third-party applications. Violations of these provisions are classified as unfair or deceptive practices, with enforcement responsibilities assigned to the Attorney General. The act is set to take effect on July 1, 2025.
