The bill amends section 448.110 of the Florida Statutes to introduce exceptions to the state minimum wage requirements. Specifically, it allows employers not to pay the minimum wage to employees participating in structured work-study, internship, pre-apprenticeship, or apprenticeship programs, provided these employees opt out of receiving the minimum wage. To do so, employees must sign a waiver acknowledging their right to the state minimum wage and voluntarily choosing to accept a lesser amount for their work-based learning opportunity. If the employee is under 18, a parent or guardian must sign the waiver on their behalf.
Additionally, the bill clarifies that certain federal regulations regarding voluntary waivers of the right to receive the state minimum wage do not apply. It also includes a severability clause, ensuring that if any part of the bill is found invalid, the remaining provisions will still be enforceable. The act is set to take effect on July 1, 2025.
