This bill amends section 448.110 of the Florida Statutes to introduce exceptions to the state minimum wage requirements for certain employees involved in structured work-study, internship, pre-apprenticeship, or apprenticeship programs. Specifically, it allows these employees to opt out of receiving the minimum wage by signing a waiver that acknowledges their right to the state minimum wage while voluntarily choosing to accept a lesser amount for their work-based learning opportunities. Additionally, if the employee is under 18 years of age, a parent or guardian must sign the waiver on their behalf.

The bill also clarifies that the federal Fair Labor Standards Act and its regulations regarding voluntary waivers of the right to receive the state minimum wage do not apply in this context. It includes a severability clause to ensure that if any provision is found invalid, it does not affect the validity of the remaining provisions. The act is set to take effect on July 1, 2025.
