This bill amends section 893.1495 of the Florida Statutes to introduce new requirements for covered entities regarding fees associated with the electronic recordkeeping system. Starting July 1, 2025, all covered entities will be required to pay specified fees on a monthly basis to the administrator of the electronic recordkeeping system, which is responsible for setting these fees. Additionally, covered entities must provide written documentation to the Department of Law Enforcement upon request to demonstrate compliance with the fee payment requirement.

The bill also establishes that failure to pay the required fees will be considered a violation of the law, subjecting the covered entity to certain criminal penalties as outlined in subsection (11). The act is contingent upon the effective date of SB 640 or similar legislation, which must be adopted in the same legislative session or an extension thereof.
