This bill amends Florida Statutes to enhance safety requirements for residential swimming pools, particularly for properties that are transferred or sold on or after October 1, 2025. It mandates that all residential swimming pools must be equipped with at least one safety feature, such as a pool barrier, safety cover, exit alarms, or pool alarms that meet specific standards. Additionally, it requires title companies, inspectors, or underwriters involved in the sale or transfer of the property to report any violations of these safety requirements to local law enforcement agencies. Failure to comply with these regulations may result in a misdemeanor charge, although penalties can be waived if the pool is equipped with the required safety features within 45 days of a citation.
The bill also introduces new pool barrier requirements, ensuring that barriers are at least four feet high and free from gaps that could allow children to access the pool area. It specifies that these barriers must be placed around the pool's perimeter and must be sufficiently distanced from the water's edge to prevent accidental falls. Furthermore, the bill amends the drowning prevention education program to ensure it is available to the public and required for individuals who violate pool safety regulations. The program may charge a fee for attendance and can be funded through various sources, including state funds and grants. The act is set to take effect on July 1, 2025.
