The bill amends Section 564.05 of the Florida Statutes, which regulates the size of individual wine containers sold in the state. Under the new law, it will be unlawful to sell wine in an individual container holding more than 1 gallon unless it is in a container holding 5.16 gallons or in specific glass container sizes (4.5 liters, 6 liters, 9 liters, 12 liters, or 15 liters). Additionally, the bill clarifies that wine sold by licensed vendors for off-premises consumption must be in the unopened original container.
The bill also specifies that qualified distributors and manufacturers can sell wine in any size container to other qualified distributors or manufacturers. A violation of this section is classified as a misdemeanor of the second degree, with penalties outlined in sections 775.082 or 775.083. The act is set to take effect on July 1, 2025.
