The bill amends section 553.8991 of the Florida Statutes to authorize the development or redevelopment of residential properties located on barrier islands, provided they have a land use or zoning designation allowing for residential development as of January 1, 2000, or any time thereafter. This means that such properties can be developed at the highest density allowed as of that date, irrespective of any current land use, zoning designations, or comprehensive plan policies that may contradict this allowance.
Additionally, the bill prohibits local governments from limiting the development potential of replacement structures below the maximum allowed by local regulations for similar parcels in the same zoning district. It also restricts local governments from imposing requirements such as the replication of demolished structures, preservation of elements from those structures, or additional regulatory burdens that would not apply to similarly situated vacant parcels. The act is set to take effect on July 1, 2025.
