The bill amends section 907.041 of the Florida Statutes to establish a presumption that no conditions of release will ensure the appearance at trial of an unauthorized alien. If a court finds probable cause that the defendant committed an offense and determines by a preponderance of the evidence that the defendant is an unauthorized alien, the state attorney or the court must move for pretrial detention. Defendants are given the opportunity to rebut this presumption by demonstrating that adequate conditions of release can secure their appearance at trial.
Additionally, the bill includes a severability clause, ensuring that if any provision is deemed invalid, the remaining provisions can still be enforced. The act is set to take effect upon becoming law.
