The bill amends section 908.11 of the Florida Statutes to require that by January 1, 2026, each law enforcement agency operating a detention facility must enter into a written agreement with the United States Immigration and Customs Enforcement (ICE) to participate in the immigration program established under section 287(g) of the Immigration and Nationality Act. This new requirement does not mandate participation in a specific program model. Additionally, the bill renumbers the existing subsection (2) to (3) and modifies its language to require law enforcement agencies that are not in compliance with this new agreement to report quarterly to the Department of Law Enforcement regarding their compliance status and any reasons for noncompliance.

The bill also includes a deletion of previous language that set a deadline of October 1, 2022, for law enforcement agencies to enter into the written agreement. Instead, the focus is shifted to the new compliance deadline of January 1, 2026. The act is set to take effect on July 1, 2025.
