The bill amends section 908.11 of the Florida Statutes to establish new requirements for law enforcement agencies operating detention facilities regarding immigration enforcement assistance agreements. Specifically, by January 1, 2026, these agencies must enter into a written agreement with the United States Immigration and Customs Enforcement (ICE) to participate in the immigration program established under section 287(g) of the Immigration and Nationality Act. The bill clarifies that participation in a specific program model is not mandated.
Additionally, the bill modifies the reporting requirements for law enforcement agencies that are not in compliance with the new agreement. Instead of a previous requirement that was set to begin by October 1, 2022, agencies must now notify the Department of Law Enforcement quarterly about their compliance status and any reasons for noncompliance. The act is set to take effect on July 1, 2025.
