This bill provides financial relief to L.P., a minor, due to injuries and damages sustained as a result of negligence by employees and caseworkers of the Department of Children and Families (DCF). The bill appropriates $28 million from the General Revenue Fund to compensate L.P., with the funds directed to Sidney and Valerie Carey, L.P.'s grandparents and adoptive parents, to be placed in a special needs trust for L.P.'s benefit. The bill acknowledges the negligence of DCF in failing to adequately respond to a wellness check that ultimately led to L.P. being left in a dangerous situation, resulting in severe injuries.
Additionally, the bill establishes that the total compensation provided by DCF and the amount awarded under this act will serve as the sole compensation for all present and future claims related to the incident. It also sets a limitation on attorney fees, stating that such fees may not exceed 25 percent of the total amount awarded. The act is set to take effect upon becoming law.
