This bill provides financial relief to Kristen and Lia McIntosh for injuries sustained due to the negligence of an employee from the Department of Agriculture and Consumer Services. The incident occurred on February 12, 2022, when Officer James Michael McWhorter, while operating a state-owned vehicle, caused a collision that resulted in severe injuries to both Kristen and Lia, as well as their parents. The family filed a lawsuit, and a settlement was reached where the Department agreed to pay its statutory limits of $300,000, while also supporting a claim bill for additional damages. A consent judgment was subsequently entered for $1.001 million to Kristen and $1.251 million to Lia, contingent upon the passage of this bill.

The bill includes several key provisions: it appropriates a total of $2.252 million from the Agricultural Emergency Eradication Trust Fund to compensate the McIntosh family, with specific amounts designated for each individual. It directs the Chief Financial Officer to issue payments to Kristen and Lia through a trust for Lia's benefit. Additionally, the bill stipulates that the total compensation provided is intended to cover all present and future claims related to the incident, and limits attorney fees to a maximum of 25 percent of the total awarded amount. The act will take effect upon becoming law.
