Following a jury trial, Ms. Ermini was awarded $1 million in damages, with a judgment of $750,000 after apportioning fault to LCSO. However, the Florida Sheriffs Risk Management Fund only paid the statutory limit of $200,000, leaving a balance of $550,000 owed to Ms. Ermini.
To address this shortfall, the bill authorizes the Florida Sheriffs Risk Management Fund to appropriate a total of $626,769.93 to compensate Ms. Ermini for her injuries and damages. This amount includes the excess judgment and additional costs awarded to her. The bill also stipulates that the total amount paid for attorney fees related to this claim cannot exceed 25 percent of the total awarded amount. The act is set to take effect upon becoming law.
