This bill seeks to provide financial relief to Patricia Ermini, who sustained severe injuries due to the negligence of the Lee County Sheriff's Office (LCSO) during a well-being check on March 23, 2012. The bill acknowledges the circumstances surrounding the incident, including the actions of the responding deputies, which led to Ms. Ermini being shot multiple times. Following a jury trial, Ms. Ermini was awarded $1 million in damages, with a judgment of $750,000 after apportioning fault to LCSO. However, the Florida Sheriffs Risk Management Fund only paid the statutory limit of $200,000, leaving a balance of $550,000 owed to Ms. Ermini.

To address this shortfall, the bill authorizes the Florida Sheriffs Risk Management Fund to pay Ms. Ermini a total of $626,769.93, which includes the excess judgment and additional costs. The bill also stipulates that the total amount paid for attorney fees related to this claim cannot exceed 25 percent of the awarded amount. Furthermore, the bill declares the facts stated in the preamble to be true and aims to provide comprehensive compensation for all present and future claims arising from the incident. The act will take effect upon becoming law.
