The bill establishes new eligibility requirements for individuals seeking to qualify as candidates for political parties or as candidates with no party affiliation in Florida. Specifically, it mandates that a person must be a registered member of the political party for at least 365 days prior to the qualifying period for the general election to qualify as a party candidate. Similarly, candidates with no party affiliation must be registered without any party affiliation and must not have been a member of any political party for at least 365 days before the qualifying period.

Additionally, the bill allows political parties, along with other entities with standing, to initiate legal actions for declaratory and injunctive relief if they believe a candidate has not complied with these new eligibility requirements. If a circuit court rules that a candidate did not meet the qualifications, that individual will be prohibited from qualifying for election, and their name will not appear on the ballot. The act is set to take effect on July 1, 2025.
