The bill amends Section 564.05 of the Florida Statutes, which regulates the size limitations for individual wine containers sold in the state. The amendment introduces an exception to the maximum allowable capacity, allowing for the sale of wine in reusable or recyclable containers that hold 5.16 gallons, as well as in glass containers of various sizes including 4.5 liters, 6 liters, 9 liters, 12 liters, or 15 liters. Additionally, it maintains that qualified distributors and manufacturers can sell wine in any size container to one another.

The bill also reiterates that wine sold for off-premises consumption must be in its unopened original container and establishes penalties for violations, classifying them as misdemeanors of the second degree. The effective date for this legislation is set for July 1, 2025.
