This bill provides for the financial relief of Marcus Button and his surviving parent, Robin Button, due to the negligence of an employee of the Pasco County School Board. It authorizes the Pasco County School Board to appropriate $1 million for Marcus Button, to be paid to a trust for his exclusive benefit, as compensation for the severe injuries he sustained in a car accident involving a school bus. Additionally, the bill allocates $200,000 to Robin Button for the harms and losses experienced by her and her deceased husband, Mark Button, as a result of their son's injuries.
The legislation also includes provisions to waive any government liens, including Medicaid liens, related to Marcus Button's treatment and care, stating that these must be paid by the state. Furthermore, it establishes that the total compensation provided under this act is intended to cover all past, present, and future claims arising from the accident, with a cap on attorney fees not exceeding 25% of the total amounts awarded. The bill is set to take effect upon becoming law.
