The bill establishes a new requirement for hospitals and ambulatory surgical centers in Florida regarding the management of surgical smoke. It creates a new section, 395.1013, in the Florida Statutes, which defines key terms such as "smoke evacuation system" and "surgical smoke." A smoke evacuation system is defined as equipment that captures, filters, and eliminates surgical smoke at its source, preventing it from affecting the eyes or respiratory tracts of individuals in the operating room. Surgical smoke is described as the gaseous byproduct produced by energy-generating devices used in surgeries, including lasers and electrosurgical devices.

By January 1, 2026, all licensed facilities are mandated to adopt and implement policies that require the use of smoke evacuation systems during any surgical procedures that are likely to generate surgical smoke. The bill is set to take effect on July 1, 2025.
