The bill amends section 825.1035 of the Florida Statutes to enhance the service of process in cases involving the protection of vulnerable adults. It introduces the concept of "unascertainable respondents," defined as individuals whose identities cannot be determined or are unknown, yet have communicated with the vulnerable adult in ways that make tracing their identity impractical. The bill allows for substitute service on these respondents, requiring petitioners to file a sworn affidavit detailing their attempts to identify the respondent and the nature of their communication with the vulnerable adult.

Additionally, the bill mandates that once the affidavit is filed, the court must issue an order for the petitioner to serve the unascertainable respondent through the same communication means used by the respondent. The petitioner must also provide proof of their service attempts. Furthermore, any proposed transfer of disputed funds or property must be held for 30 days following the issuance of a final injunction order. This legislation aims to provide better protection for vulnerable adults by ensuring that legal processes can proceed even when the identity of a respondent is not readily ascertainable. The act is set to take effect on July 1, 2025.
